Terms of Service
By commissioning me, you are agreeing to the following terms. Please read carefully before placing an order.
- Note: all payments will be through VGen/Stripe (credit card, apple pay, google pay, etc.)GENERAL
• You agree that you are at least 18 years of age OR OLDER before commissioning me.
• Commissions are for Personal Use only, unless commercial rights are purchased. (Additional fees apply depending on service.)
• My artwork may be used for personal display such as profile pictures, banners, posting on Socials with Credit, or printing for yourself, but may not be used for profit without prior agreement.
• AI/NFT use is strictly prohibited. My work may not be used in AI datasets, engines, or minted as NFTs.
• I reserve the right to decline commissions outside my abilities or for subjects I will not draw.
• Communication is important. If I do not receive a response within 7 days, I will proceed and deliver the artwork as is.
• If you request variant versions of a commissioned design, an additional fee of 50%-95% per variation will be applied depending on complexity.
• I reserve the right to refuse service from/blacklist people who support and promote hateful ideologies (i.e. : MAGA, trump supporters, nazis, racists, anti-LGBTQ+, etc)Will Draw: Fanart, O.C.s, furry, humanoid/semi-humanoid robots, monsters/aliens, humans, mild-to-modertate gore, horror-themes, NSFWWon’t Draw: Loli/shota, diaper-centric art, scat, extreme gore (it’s beyond my ability), vore (hinted/teased at is fine), extreme hypertrophilia (it’s beyond my ability), complicated poses/backgrounds, mecha and/or non-humanoid machinesDEADLINES AND DELIVERY
• 1-8 weeks (depending on complexity of commission)
• I will keep you updated if delays occur.PAYMENTS & FEES
- Payments & Fees will be converted to your currency, but are listed as USD in this TOS• All payments are upfront in full.
• You may request a 50/50 payment (half upfront, half after proposal/sketches have been fully agreed upon) This does not apply to sketch/doodle or “surprise me”/skeb commissions, which must be paid upfront
• Payments to proposals should be paid fully including tax within 1 week or will be declined.
• A Non-Disclosure Agreement (NDA) fee of $75 applies if you request that I do not post your commission publicly or use it as part of my Portfolio.
• Complexity Fee is between $2-$30 for all Commissions.
• If a Commissioner wishes to buy Commercial Use AFTER a commission, the prices will be: Streamer Commercial Use ($25 USD) and Merchandise Commercial Use ($50 USD)REVISIONS
• You receive 2 free revisions after the sketch is approved. Additional revisions cost $5 each, paid before I continue.
• Once the Final is approved, no further changes will be made unless due to an error on my part. Mistakes I make will always be corrected at no cost.INTELLECTUAL PROPERTY RIGHTS
I, the artist, retain all copyright and intellectual property rights to the commissioned artwork. The client is purchasing non-exclusive usage rights, not ownership of the artwork itself. This means the client does not own the copyright: they may not claim credit, cannot profit off the artwork (Unless they purchase necessary licenses), and cannot greatly alter the artwork without my permission (small alterations after purchase are fine).I may use the artwork to:
Promote myself and my services.
Post on social media and in my portfolio.
Create prints/merchandise (for fanart commissions only).
Exceptions:
If an NDA is purchased, the artwork will not be posted or used for promotional purposes.REFUNDS
• No refunds UNLESS I am unable to complete the commission
• I may cancel and refund a commission at any time.
• You may cancel before payment is made.
• Chargebacks are strictly prohibited.
Filing a chargeback will:
• Forfeit your rights to use the artwork.
• Place you on a public blacklist (with evidence).
• Allow me to resell or reuse the artwork as I see fit.
• Result in a formal complaint against you.COMMISSIONER RIGHTS
You may:
• Use the artwork for personal purposes only (unless commercial rights are purchased).
• Print the art for yourself.
• Post it on Social Media with credit to "@Moth_Cryptid on Vgen”

• Use the artwork commercially without permission/purchase of commercial license.
• Claim the artwork as your own or fail to credit me.
• Remove signatures/watermarks.
• Resell or redistribute the artwork (beyond what the commercial license allows)
• Use artwork purchased for Personal Use in merch, streaming, or commercial projects.
• If purchasing an adoptable – you may only resell if: you sell for the same price OR LOWER than you purchased it for.
- You may increase the price of the adoptable if you commission other artworks using the design
- You must message/notify me of the re-sale of the adoptable and tell me who has purchased it so that I can keep trackBLACKLIST POLICY
• Breaking these rules may result in a permanent public blacklist (with evidence).
• The blacklist may be shared with other artists.FINAL AGREEMENT
• By commissioning me, you acknowledge that you have read, understood, and agreed to all of the terms above.
